These Terms and Conditions (the "Terms") apply to purchases and use of the WYNCH online store at https://wynch.wine (the "Site"). The Site is operated by Winest GmbH ("WYNCH", "we", "us" or "our").

By using the Site or placing an order, you agree to these Terms, our Privacy Policy and any other policies referenced during checkout. If you do not agree, please do not use the Site.

Eligibility And Alcohol Sales

We sell alcoholic beverages. By placing an order, you confirm that you are legally permitted to purchase alcohol in the delivery country and that all information you provide is accurate and complete. We may refuse, cancel or delay orders if age, identity, payment or delivery eligibility cannot be verified. Delivery partners may also request proof of age or identity before handing over alcoholic products.

Products And Availability

We aim to describe products, prices, vintages, images and availability accurately. Minor differences in packaging, labels, bottle appearance or screen color may occur. Product availability can change and we may limit quantities or discontinue products at any time. If an ordered product becomes unavailable, we will contact you and, where appropriate, offer a refund or alternative.

Orders And Contract Formation

Products shown on the Site are an invitation to place an order. When you submit an order, you make an offer to buy the selected products. A contract is formed only when we accept the order, for example by sending an order confirmation or dispatch confirmation. We may reject or cancel orders where permitted by law, including in cases of incorrect pricing, suspected fraud, product unavailability, payment issues or delivery restrictions.

Prices, Taxes And Payment

Prices are shown in the currency displayed on the Site and include VAT where required by law unless stated otherwise. Shipping costs, delivery charges and any additional fees are shown before checkout is completed. Payment is processed by third-party payment providers. You must provide valid and authorized payment information.

Delivery

We deliver to the destinations available at checkout. Delivery times are estimates unless expressly stated otherwise. We are not responsible for delays caused by carriers, customs, incorrect delivery details or events outside our reasonable control. You must provide a complete and accurate delivery address and ensure that an eligible recipient is available to receive alcohol deliveries.

Right Of Withdrawal, Returns And Refunds

Consumers may have a statutory right of withdrawal for online purchases. Details are set out in our Refund Policy. Your statutory consumer rights and legal warranty rights remain unaffected.

Customer Accounts

You may be able to create a customer account. You are responsible for keeping your login details confidential and for all activity under your account. Please notify us immediately if you suspect unauthorized access.

Loyalty Program And Promotions

We may offer loyalty rewards, referral benefits, vouchers, gift cards or promotions. These may be subject to additional terms displayed on the Site or during the promotion. Rewards and promotional benefits have no cash value unless expressly stated and may not be transferred, sold or misused.

The Site is powered by Shopify and may include services or links provided by third parties, such as payment, shipping, analytics, marketing or social media providers. We are not responsible for third-party websites or services that we do not control. Their own terms and privacy policies may apply.

Liability

Nothing in these Terms limits liability where limitation is not permitted by law, including liability for intent, gross negligence, injury to life, body or health, fraudulently concealed defects or mandatory product liability. Otherwise, we are liable in accordance with applicable law.

Changes To The Site And Terms

We may update the Site, product information and these Terms from time to time. The Terms that apply to your order are the Terms in effect when the order is placed, unless a mandatory legal rule requires otherwise.

Governing Law

These Terms are governed by the laws of Germany. If you are a consumer, mandatory consumer protection rules of the country in which you habitually reside remain unaffected.
